Definition of Terms
- Whitewater Recruitment: Us, we, our, crew agency
- Client: The motor/sailing yacht or organisation which employs you via Whitewater Recruitment
- You: The candidate, crew member, or person registering with Whitewater Recruitment
- MLC: The International Labour Organisation (ILO) Maritime Labour Convention (MLC, 2006)
1. Non-Discrimination & Blacklist Policy
Whitewater Recruitment operates a professional recruitment service in a fully non-discriminatory manner, regardless of gender, sexuality, race, religion, age, or disability.
We welcome applications from individuals of all backgrounds and do not maintain or operate any form of ‘blacklist’.
2. Candidate Fee Policy
- Whitewater Recruitment does not charge candidates for registering or for being represented.
- All recruitment-related fees are paid by the client (the employer).
- Candidates must never be asked to pay any part of the recruitment fee, nor make any payment to secure employment.
3. Crew Requirements
By registering with Whitewater Recruitment, you confirm that:
- All information provided in your CV and documents is accurate to the best of your knowledge.
- Qualifications, certificates, and references submitted are genuine and unaltered.
- You accept these terms and conditions by ticking the relevant box when registering. If you do not accept them, we are unable to represent you.
- You consent to us using the information you provide to assist you in finding employment opportunities.
- You will carry original documentation with you when attending interviews or joining a vessel.
- If placed via Whitewater Recruitment, you will provide either:
- A copy of your signed employment contract; or
- An email confirming you have received, signed, and are satisfied with your contract (where policy prevents sharing the contract directly).
4. Seafarers’ Rights
Under MLC 2006, all seafarers are entitled to basic rights and protections, including but not limited to:
- A written employment contract in English detailing wages, hours of rest, leave entitlements, and repatriation terms
- The opportunity to review and seek advice on your contract before signing
- A copy of your signed contract
- Rest hours: 10 hours per 24-hour period, 77 hours per 7 days
- 2.5 days of leave per month served
- Repatriation to your home country
- Safe, suitable accommodation and recreational facilities onboard

5. Complaints Procedure
Whitewater Recruitment aims to provide an excellent service to all crew members. If you have any concerns:
- Please contact us at hello@whitewaterrecruitment.com and include “Complaint” in the subject line.
- We will acknowledge your email and investigate the matter internally.
- A response will be issued within 4 weeks.
- If you are dissatisfied with the outcome, you may escalate your concern to the Maritime and Coastguard Agency (MCA) at mlc@mcga.gov.uk
6. Privacy Policy / GDPR Compliance
Whitewater Recruitment is committed to protecting your personal data in line with the Data Protection Act 2018 and the UK GDPR.
Data Collection & Usage
We collect personal data to support your job search and secure employment for you. This may include:
- Full name, email, phone number, date of birth
- CV, work history, job preferences, qualifications, references
- Passport, visas, medical information (if required), criminal background check outcomes
This information is used to:
- Match your profile to available vacancies
- Submit your details to clients and employers
- Carry out legal checks (right to work, medical clearance, etc.)
- Keep you updated on job opportunities and our services
You may receive newsletters or job updates; you can unsubscribe at any time via email link or by contacting us.
Data Storage
- All data is stored securely on GDPR-compliant servers based in the UK.
- Only Whitewater Recruitment staff have access to the database.
- Data is retained until you request deletion, or when no longer necessary.
We may share your information with clients located outside the European Economic Area (EEA) if necessary for employment.
Deletion of Data
You have the right to request deletion of your data in any of the following circumstances:
- It is no longer necessary for the original purpose
- You withdraw your consent
- The data was processed unlawfully
- We are legally obliged to erase the data
Requests will be fulfilled within one month unless the request is complex, in which case we may extend this by up to two further months.
Disclosure of your information:
Your CV and related information will be shared or sent to prospective employers and our clients. Once you have secured a placement additional information will be provided to them to enable the placement to proceed. Such employers and clients will usually be located inside the European Economic Area (EEA) but may be outside of the EEA.
